🌐 GLOBAL TERMS OF SERVICE | TÉRMINOS DE SERVICIO GLOBALES — (English Version followed by Spanish Version)

Inglés Fácil (hereinafter "the App" or "the Service") is owned, developed, and operated by Fonsek Companies LLC, a limited liability company registered in the State of Michigan, USA (hereinafter "we," "us," "our," or "the Company"). By creating an account, downloading, accessing, or using the App, you ("you" or "User") acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.
You must be at least 13 years old to create an account. If you are between 13 and 18 (or the age of majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. To purchase a subscription, you must be of legal age to enter into a binding contract in your country of residence (typically 18+). You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to notify us immediately of any unauthorized access.
Inglés Fácil is an educational mobile application for learning English as a second language, featuring structured lessons (levels A1–C1), an AI conversational tutor named "Buddy," guided role-play "Situations," progress tracking, and gamification (XP, streaks). The App is provided in a "freemium" model: certain features are free, while others require an active Pro subscription.
The Pro Service costs $4.99 USD per week (or local-currency equivalent set by the stores), typically following a 7-day free trial available to first-time subscribers only. Prices, billing periods, and trial availability may vary by region and may be modified at any time; continued use after a notified price change signifies acceptance.
Subscriptions renew automatically at the end of each billing period (weekly) unless canceled at least 24 hours before the current period ends. The renewal will be charged to the payment method on file with the corresponding app store within 24 hours of the period's end.
If you start a free trial and do not cancel at least 24 hours before it expires, your account will automatically convert to a paid subscription and you will be charged the then-current price. Trials are non-transferable and limited to one per user/household.
Subscription payments are processed exclusively by Apple Inc. (iOS users, via the App Store) or Google LLC (Android users, via Google Play Billing). Entitlement validation is performed in coordination with RevenueCat, Inc., our subscription infrastructure provider. We never receive, store, or process your credit card number or banking information.
You can cancel your subscription at any time directly in your Apple App Store account settings (Settings → Apple ID → Subscriptions) or Google Play account settings (Play Store → Subscriptions). Cancellation takes effect at the end of the current billing period; you retain access to Pro features until then. Uninstalling the App does not cancel your subscription.
If you are a consumer in the European Union, European Economic Area, or United Kingdom, you may have a 14-day right of withdrawal from digital service contracts. By starting to use the Pro Service immediately upon purchase, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once the digital content has been supplied.
Because purchases are processed by Apple or Google, refund requests must be submitted directly to the corresponding store. Fonsek Companies LLC does not process refunds directly. If you initiate a refund through the App Store or Google Play, you consent to our sharing of consumption data (session duration, features used, message count) with Apple or Google to validate the request.

We reserve the right to investigate suspected violations, suspend or terminate accounts, and report illegal activity to the appropriate authorities.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." Buddy is an artificial intelligence tutor powered by Google Gemini (Generative Language API) and Google Cloud Text-to-Speech. AI-generated output may be inaccurate, outdated, biased, or inappropriate ("hallucinations"). We disclaim all warranties regarding the accuracy, completeness, fitness for a particular purpose, or non-infringement of any educational content generated by the AI. Inglés Fácil is an informal educational tool and is not a substitute for accredited language instruction, professional translation, legal, medical, immigration, or financial advice. We do not issue official certificates, diplomas, or credentials recognized by any government or accrediting body.
Use of the App is prohibited in territories subject to U.S. embargoes or comprehensive sanctions. By using the App, you certify that you are not located in, nor a resident or national of: Russia, China, Iran, North Korea, Cuba, Syria, Belarus, or the sanctioned regions of Ukraine (Crimea, Donetsk, Luhansk, Kherson, Zaporizhzhia), and that you are not on any U.S. Treasury Department (OFAC) restricted-persons list.
You retain ownership of the messages, voice transcriptions, and text you submit to the App ("User Content"). You grant Fonsek Companies LLC a worldwide, non-exclusive, royalty-free license to process, transmit, store, and display your User Content solely as necessary to operate the Service, generate AI responses, validate refunds, and improve quality (in aggregated, de-identified form only). We do not sell your User Content.
All content, branding, lessons, audio, graphics, source code, AI prompts, and the "Inglés Fácil" name and logo are the exclusive intellectual property of Fonsek Companies LLC, protected by U.S. and international copyright and trademark laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only. Any feedback or suggestions you submit may be used by us without compensation, attribution, or obligation to you.
If you believe that content available in the App infringes your copyright, send a written notice to hola.inglesfacil@gmail.com including: (i) your contact information; (ii) a description of the copyrighted work; (iii) the location in the App; (iv) a statement of good-faith belief that the use is unauthorized; (v) a statement under penalty of perjury that the information is accurate and you are the owner or authorized agent; and (vi) your signature.
We reserve the right to modify, suspend, or permanently discontinue the App or any part of the Service (including Buddy) at any time, with or without notice. We may also terminate or suspend your account at our sole discretion if you violate these Terms. In the event of a permanent shutdown of the Service, we will (when reasonably possible) notify users in advance and provide a means to export progress; Fonsek Companies LLC is not liable for data loss or service interruption due to scheduled maintenance, technical failures, or force-majeure events.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FONSEK COMPANIES LLC, ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, REPUTATION, OR LEARNING OUTCOMES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE LAST SIX (6) MONTHS, OR (B) USD $50. Nothing in these Terms limits liability that cannot be excluded by applicable consumer-protection law in your jurisdiction.
You agree to indemnify and hold harmless Fonsek Companies LLC from any third-party claim, loss, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms, your User Content, or your misuse of the Service.
These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved by final, individual, binding arbitration administered in Ottawa County, Michigan, under the rules of the American Arbitration Association (AAA). YOU AND FONSEK COMPANIES LLC EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction for intellectual-property infringement. EU/UK consumers retain any mandatory rights to bring claims in their country of residence.
We may modify these Terms at any time. Material changes will be communicated through the App or by email at least 7 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree to the updated Terms, you must stop using the App and may cancel your subscription.
The App relies on services provided by Google (Firebase, Gemini, Cloud Text-to-Speech), Apple (Sign in with Apple, App Store), and RevenueCat. Your use of those services is also subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.
If you access the App through Apple's App Store, you acknowledge that these Terms are between you and Fonsek Companies LLC only — not with Apple. Apple is not responsible for the App or its content. Apple has no warranty obligations and is not responsible for addressing claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you access the App through Google Play, your use is also subject to the Google Play Terms of Service. Google is not responsible for the App or its content.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fonsek Companies LLC concerning the Service and supersede any prior agreements.

Acepta proporcionar información veraz, actualizada y completa, y notificarnos de inmediato cualquier acceso no autorizado.
Inglés Fácil es una aplicación móvil educativa para aprender inglés como segundo idioma, que ofrece lecciones estructuradas (niveles A1–C1), un tutor conversacional con IA llamado "Buddy", "Situaciones" de práctica guiada, seguimiento de progreso y gamificación (XP, rachas). La App se ofrece en modelo "freemium": ciertas funciones son gratuitas y otras requieren una suscripción Pro activa.
El servicio Pro cuesta $4.99 USD por semana (o su equivalente en moneda local fijado por las tiendas), generalmente tras una prueba gratuita de 7 días disponible solo para suscriptores nuevos. Los precios, periodos de facturación y disponibilidad de la prueba pueden variar por región y modificarse en cualquier momento; el uso continuado tras una notificación de cambio implica su aceptación.
Las suscripciones se renuevan automáticamente al final de cada periodo de facturación (semanal) a menos que se cancelen al menos 24 horas antes del fin del periodo actual. La renovación se cargará al método de pago registrado en la tienda dentro de las 24 horas previas al final del periodo.
Si inicia una prueba gratuita y no la cancela al menos 24 horas antes de que termine, su cuenta se convertirá automáticamente en suscripción de pago y se le cobrará el precio vigente. Las pruebas son intransferibles y se limitan a una por usuario/hogar.
Los pagos son procesados exclusivamente por Apple Inc. (usuarios iOS, vía App Store) o Google LLC (usuarios Android, vía Google Play Billing). La validación de la suscripción se realiza en coordinación con RevenueCat, Inc., nuestro proveedor de infraestructura de suscripciones. Nunca recibimos, almacenamos ni procesamos números de tarjetas de crédito ni datos bancarios.
Puede cancelar su suscripción en cualquier momento directamente en los ajustes de su cuenta de App Store (Ajustes → Apple ID → Suscripciones) o de Google Play (Play Store → Suscripciones). La cancelación surte efecto al final del periodo de facturación actual; conserva el acceso Pro hasta entonces. Desinstalar la App no cancela la suscripción.
Si es consumidor en la Unión Europea, el Espacio Económico Europeo o el Reino Unido, puede tener un derecho de retracto de 14 días para contratos de servicios digitales. Al comenzar a usar el servicio Pro inmediatamente tras la compra, usted consiente expresamente la ejecución inmediata del contrato y reconoce que pierde su derecho de retracto una vez que el contenido digital ha sido suministrado.
Como las compras son procesadas por Apple o Google, las solicitudes de reembolso deben dirigirse directamente a la tienda correspondiente. Fonsek Companies LLC no procesa reembolsos directamente. Si solicita un reembolso a través de App Store o Google Play, usted acepta que compartamos datos de consumo (duración de sesión, funciones usadas, número de mensajes) con Apple o Google para validar la solicitud.

Nos reservamos el derecho a investigar sospechas de incumplimiento, suspender o cancelar cuentas, y reportar actividades ilegales a las autoridades correspondientes.

Inglés Fácil es una herramienta educativa informal y no sustituye la instrucción acreditada de idiomas, traducción profesional, ni consejo legal, médico, migratorio o financiero. No emitimos certificados, diplomas ni credenciales reconocidas por ningún gobierno u órgano de acreditación.
El uso de la App está prohibido en territorios sujetos a embargos o sanciones integrales de EE. UU. Al usar la App, usted certifica que no se encuentra en, ni es residente o nacional de: Rusia, China, Irán, Corea del Norte, Cuba, Siria, Bielorrusia o las regiones sancionadas de Ucrania (Crimea, Donetsk, Luhansk, Kherson, Zaporiyia), y que no figura en ninguna lista restringida del Departamento del Tesoro de EE. UU. (OFAC).
Usted conserva la propiedad de los mensajes, transcripciones de voz y texto que envíe a la App ("Contenido del Usuario"). Otorga a Fonsek Companies LLC una licencia mundial, no exclusiva, libre de regalías para procesar, transmitir, almacenar y mostrar su Contenido del Usuario únicamente para operar el Servicio, generar respuestas de IA, validar reembolsos y mejorar la calidad (en forma agregada y des-identificada). No vendemos su Contenido del Usuario.
Todo el contenido, marca, lecciones, audios, gráficos, código fuente, prompts de IA y el nombre y logo "Inglés Fácil" son propiedad intelectual exclusiva de Fonsek Companies LLC, protegidos por las leyes de derechos de autor y marcas de EE. UU. e internacionales. Le otorgamos una licencia limitada, no exclusiva, intransferible y revocable para usar la App con fines personales y no comerciales. Los comentarios o sugerencias que envíe pueden ser utilizados por nosotros sin compensación, atribución ni obligación alguna hacia usted.

Si accede a la App a través del App Store de Apple, reconoce que estos Términos son entre usted y Fonsek Companies LLC únicamente — no con Apple. Apple no es responsable de la App ni de su contenido.
